Abone
The natural or legal person who uses the Service based on the Service Order. The Subscriber is responsible for fulfilling the obligations determined in the Provider's GTC.

Hizmet
This Service is provided by the Provider against advance payment of the fee.

Hizmet Siparişi
The contract representing the legal relationship between the Provider and the Subscriber is the "Online Order". Based on this, the Provider provides the Service to the Subscriber, who is obliged to comply with the conditions described in the General Terms and Conditions and to pay the fee determined in the Online Price List in time for the Service used. The Provider is obliged to comply with the obligations undertaken in the General Terms and Conditions.

Abonelik Sözleşmesi
The legal relationship established between the Subscriber and the Provider, which comes into effect by accepting the "GTC" on the Hostingbazis.hu website.

Ücretlendirme
The Subscriber pays a predetermined monthly, quarterly, semi-annual, or annual fee in advance for the use of the Service(s). The Provider sends an invoice to the Subscriber's email address within 14 days of payment. The Provider only issues electronic invoices, and the Subscriber acknowledges and accepts this. Paper invoices are not available.

Purpose and Subject of General Terms and Conditions
The Provider has issued the General Terms and Conditions (GTC) in accordance with applicable legal regulations to regulate in detail the conditions related to the Service and its use, the rights and obligations of the Provider and the Subscriber, and other essential circumstances related to the Service.
The current text of the GTC at all times contains the general conditions of the service relationship as part of the subscriber agreement established between the Provider and the Subscriber entering into a contractual relationship with it. Regarding matters not regulated here, the applicable Hungarian legal regulations and official provisions related to the Provider's activities, as well as the provisions contained in the Civil Code and the binding conditions of appropriately published international contracts and standards shall apply without special stipulation.

THE SERVICE 
The Provider's obligation is to provide the Service to the Subscriber under the following conditions and the provisions of these General Terms and Conditions.
Geographical scope of the Service
The Provider provides the Service on its own or partners' servers, meaning the software, database, or other uploaded electronic materials that enable the service are located on the Provider's server or a server rented by it.
Temporal scope of the Service – Establishment and modification of the subscriber relationship
The subscriber relationship is established when the Subscriber orders the Service on the Online interface and pays the predetermined advance fees specified in the Pricing, as a result of which the Provider provides Webhosting and other services to the Subscriber within the framework of the service. The Provider provides the necessary data to the Subscriber for setting up this service. The Provider provides the Service continuously, 24 hours a day, without time limitations.
The Provider provides Service of appropriate quality in the manner expected from it, under the available and technically feasible conditions, and ensures proper development, operation, supervision, and maintenance of the server software system it operates. The Provider undertakes to install the web server/TS3 server/VPS server serving the system in the direct vicinity of the Hungarian or French internet backbone network, where the nominal data transmission speed of the server communication is minimum 100 Mb/s bandwidth. The Provider further undertakes to ensure minimum 99.9% annual availability of the web server/TS server/VPS server.

Error Reporting, Error Resolution
The Subscriber can report errors detected in connection with the Service to the Provider online (by email to [email protected]), on Skype (hostingbazis.hu), or in the online ticket system (ugyfelkapu.hostingbazis.hu). The Subscriber will be informed about the time of error resolution. The error condition cannot persist for more than 24 hours.
The Provider reserves the right to perform maintenance on its web server, TS3 server, VPS server, server software, and database on a monthly basis to maintain the proper quality of the service. The Provider must notify the maintenance time 48 hours in advance.

RIGHTS AND OBLIGATIONS OF THE PROVIDER

A Szolgáltató szolgáltatási kötelezettsége és felelőssége a minőségért
A Szolgáltató a Szolgáltatást az Előfizetői Szerződésben meghatározott időponttól az Előfizető számára folyamatosan biztosítja az Előfizető díjfizetési kötelezettségének teljesítése ellenében. A Szolgáltató a Szolgáltatás teljesítése során és a Szolgáltatás megfelelő minőségének biztosítása érdekében minden tőle elvárható intézkedést megtesz annak érdekében, hogy tevékenységét úgy fejtse ki, ahogy szolgáltatóktól az adott helyzetben általában elvárható. Ennek keretében a Szolgáltatás biztosítását működtető rendszert folyamatosan ellenőrzi, karbantartja, esetleges meghibásodás esetén – a rendelkezésre álló műszaki lehetőségek keretein belül – megfelelően javítja.
A Szolgáltató nem felel olyan károkért, amelyek belföldi vagy külföldi hatósági rendelkezés, szükséges hatósági engedély megtagadása vagy késedelmes megadása, erőhatalom, természeti csapás (vis major), vagy egyéb, a Szolgáltató érdekkörén kívülálló ok, illetve esemény folytán következnek be, amelyekért a Szolgáltató nem tehető felelőssé, illetve az olyan károkért, amelyek az Előfizető érdekkörében, vagy az Általános Szerződési Feltételekbe foglalt feltételek Előfizető általi be nem tartásának, illetve késedelmes teljesítésének eredményeként következtek be. A szolgáltató továbbá nem vállal felelősséget esetleges DDoS támadásokért sem.
A Szolgáltató a Szolgáltatás esetleges nem megfelelő minőségéből eredő, illetve az általa működtetett weblaprendszer esetleges meghibásodásával, működésében bekövetkező zavarokkal kapcsolatosan keletkezett közvetlen károkért csak a 24 órát meghaladó meghibásodás esetén vállal felelősséget, a kapcsolódó és közvetett károkért nem vállal felelősséget.
A Szolgáltató a szolgáltatási jogviszonyból eredő szerződéses kapcsolata során az Előfizetővel együttműködik. Ennek érdekében a Szolgáltatás szempontjából jelentős tényekről, körülményekről, változásokról az Előfizetőt haladéktalanul tájékoztatja.
Az Előfizető a Szolgáltatás működésével kapcsolatos felszólalásait a Szolgáltató ügyfélszolgálatánál terjesztheti elő, e-mail-ben vagy írásban. A Szolgáltató a felszólalásokat minden esetben kivizsgálja és ennek eredményéről az Előfizetőt tájékoztatja.

Protection of Personal Data
The Provider handles information and data that come to its attention in connection with the Service and the operation of its network confidentially in accordance with the provisions of applicable legal regulations. The data are not provided to third parties and are not made accessible to them – except in cases of explicit legal provision – as long as the Subscriber fully complies with the obligations contained in the Subscriber Agreement. With the Order, the Subscriber unconditionally agrees that if they do not fulfill their obligations, the Provider may provide the necessary Subscriber data to third parties also bound by confidentiality for the purpose of subscriber identification and/or enforcement of claims.

RIGHTS AND OBLIGATIONS OF THE SUBSCRIBER
Az Előfizető az Előfizetői Szerződés megkötésével egyidejűleg egyszeri előfizetési díjat, valamint a Díjszabásban meghatározott esedékes díjakat köteles megfizetni, ezen díjak megfizetései előfeltétele a Szolgáltató rendszeréhez való csatlakozásnak. A fenti díjakon felül az Előfizető által választott havi, negyedéves, féléves vagy éves rendszerességgel az Előfizető igénybevételi díjat köteles fizetni, amennyiben ezt jelölte meg a Szolgáltatás Megrendelőn. A díjak mértéke a mindenkor érvényben lévő Díjszabásban foglaltak alapján kerül meghatározásra. A Díjszabás a Szolgáltatás Megrendelő részét képezi.
Az Előfizetői Szerződés alapján az Előfizető a Szolgáltató részére az általa nyújtott Szolgáltatásért a Szolgáltató által a tárgyidőszakot megelőzően kiállított és megküldött díjbekérő ellenében díjfizetésre kötelezett az Előfizetői Szerződés mindenkori mellékletét képező Díjszabás feltételei szerint. Az Előfizető a díjakat Paypalen, smsben vagy átutalással teljesítheti.
Az Előfizető a számlában meghatározott díj összegszerűségét az ott jelzett fizetési határidőn belül az ügyfélszolgálatnál vitathatja.  A Szolgáltató a kifogást minden esetben érdemben megvizsgálja. Kétség esetén a számlában foglaltak helyességét a Szolgáltatónak kell bizonyítania. Amennyiben a kifogás megalapozott, úgy a Szolgáltató a tévesen megállapított összeget az Előfizető részére a következő időszakos számlában jóváírja. A Szolgáltatónak jogában áll, az Előfizető értesítése mellett, az esetleges jogszabályváltozások miatt, illetve annak megfelelés érdekében a számlázási időszakot, a számlázás időpontját módosítani.
Amennyiben az Előfizető a díjbekérőn szereplő díjat az ott jelzett fizetési határidő lejáratáig nem egyenlíti ki vagy nem igazolja, hogy az összeg átutalásához szükséges valamennyi intézkedést megtette, a Szolgáltató jogosult a Szolgáltatás igénybevételét, illetve a Szolgáltatáshoz való hozzáférési jogosultságot azonnali hatállyal korlátozni vagy felfüggeszteni. Amennyiben a fenti intézkedések ellenére az Előfizető a Szolgáltatót megillető díjakat nem egyenlíti ki, a Szolgáltató 10 nap elteltével törli a Szolgáltatást, és azonnali hatállyal felfüggeszti a szerződést.
A Szolgáltatás díjának megfizetéséért a Megrendelő a felelős, függetlenül a Szolgáltatás tényleges igénybe-vevőjétől.

Data Provision
The Subscriber declares that they are authorized to conclude the Subscriber Agreement in their own name and their contractual capacity is not limited.
The Subscriber must immediately notify the Provider of any changes in their data, particularly data related to billing and Service performance. The Provider is not liable for damages arising from the Subscriber's failure to immediately notify of changes in the Subscriber data provided to it, however, it may demand compensation for damages arising in connection with the Subscriber's breach of contract from the Subscriber.

Data Protection
Az Előfizető tudomásul veszi, hogy az Előfizetői Szerződés keretében igénybevett Szolgáltatás használata során ő felel a feltöltött adatok, információk és képek használatának jogszerűségért, azok tartalmáért. Szolgáltató fenntartja magának a jogot, hogy a tartalmat illetve azok használatának jogszerűségét illetően kérdéses vagy vitás esetekben a Szolgáltatást és a hozzáférést az adott weblap szempontjából felfüggessze.
Minden az Előfizető által feltöltött információnak tekintettel kell lennie a társadalmi értékekre és az emberi méltóságra és nem lehetnek olyan természetűek, amelyek: bárkit törvényellenes cselekvésre bátorítanak vagy bújtatnak fel; súlyos vagy széleskörű ellenállást váltanak ki; pontatlanságuk, kétértelműségük, túlzó mivoltuk, hanyagságuk, vagy bármi más miatt félrevezetők; faji, vallási vagy politikai ellentéteket szítanak vagy hirdetnek; bármi olyan szokásban vagy cselekvésben való részvételre bátorít, vagy buzdít fel, amely valaki egészségére vagy biztonságára nézve valószínűleg hátrányos; szexuális, erőszakos vagy trágár tartalmuk révén megbotránkozást keltenek; hamisak vagy elavultak.

Data Transfer Statement
Online bank card payments are processed through the SimplePay and Barion systems.

SimplePay:
The Subscriber accepts that the following personal data stored in the Provider's user database will be transferred to OTP Mobil Kft. (1093 Budapest, Közraktár u. 30-32.) as data controller. The scope of transferred data: name, email address, phone number, billing address data and delivery address data
Purpose of data transfer: customer service assistance for users, transaction confirmation, and fraud monitoring conducted for user protection.

Barion:
Bank card data do not reach the merchant. The service provider Barion Payment Zrt. is an institution under the supervision of the Hungarian National Bank, license number: H-EN-I-1064/2013."

Other Obligations
The Subscriber acknowledges that during the use of the Service within the framework of the Subscriber Agreement, they must refrain from harassing behavior and conduct that offends public morals and human dignity. If the Subscriber fails to fulfill this obligation, the Provider is entitled to request the Subscriber to immediately cease the improper conduct. If the Subscriber fails to fulfill this obligation despite the request, the Provider is entitled to suspend the use of the Service.

Obligations Related to TeamSpeak Query and Voice Services
The Subscriber acknowledges that they can use the service exclusively with the connection addresses specified to them at the time of order and later displayed on the administrative interface. If they attempt to connect in any other way, share it with others, or display it on their website or other interface, they commit a contractual breach, which results in immediate service suspension without warning.


TERMINATION OF SUBSCRIBER AGREEMENT
The Subscriber can terminate the indefinite-term contract at any time through our client portal system or by email.

Additionally
The Subscriber acknowledges that the Provider may also involve subcontractors to ensure the provision of the service.
The Subscriber will take all reasonable measures to prevent spamming.
The Subscriber accepts the network usage guidelines supported by the Internet Service Providers Council (ISzT), which were published on the page http://www.iszt.hu/iszt/aup.html.
